WV Insurance Claim Case Settles
We were hired to represent a veteran who was seriously injured in a car accident near Lewisburg, West Virginia. During the case against the driver that caused the accident, we asked our client’s own insurance company to confirm whether he had underinsured insurance that would cover the accident. The insurance company responded in writing and confirmed that our client had $20,000 of underinsured motorist coverage.
After settling the case with the negligent driver’s insurance, we demanded policy limits from our client’s insurance company. Amazingly, the insurance company denied coverage and stated that our client did not have any underinsured motorist coverage. Even after pointing out that the company had already confirmed the amount of limits, they refused to pay.
We filed a first party bad faith case against the insurance company and were able to force a payment of the full coverage amount plus our attorney’s fees based on West Virginia law.
